Terms of Service

1. Acceptance of Terms

Texther ("the Service") is operated by TMM Capital ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Texther. By using the Service, you represent and warrant that you meet this age requirement.

3. What Texther Is

Texther is a conversation practice app. It simulates text message exchanges so you can practice and get feedback on what you write.

All conversations are simulated. You are interacting with fictional personas, not real people.

Personas are fictional. As part of the exercise, they can lose interest, stop replying, or end a conversation.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access to your account

5. Subscription and Billing

Texther requires a paid subscription. Beyond the introductory exercise, access to the Service is available to subscribers only.

Plans

• Weekly: $7.99 per week
• Annual: $89 per year

Fair Use

Subscriptions are subject to fair use limits on how much you can send and how many conversations you can start in a day. We apply these limits automatically to keep the Service available to everyone, and we may adjust them. Contact us if you believe a limit has been applied to you in error.

Auto-Renewal

• Payment is charged to your Apple ID account when you confirm the purchase
• Your subscription renews automatically at the same price for the same period unless you cancel at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours before the end of the current period
• You can manage or cancel your subscription in your App Store account settings at any time
• We will tell you at least 30 days in advance before any price change takes effect

Refunds and Withdrawal

• Purchases are made through the Apple App Store. Refund requests are handled by Apple at reportaproblem.apple.com
• If you are a consumer in the EU, you normally have 14 days to withdraw from a purchase. By subscribing and starting to use the Service straight away, you ask us to begin performance during that period and you acknowledge that you lose the right of withdrawal once the Service has been fully performed
• Nothing here limits any statutory right you have as a consumer under the law of your country of residence

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Write about identifiable real people. Do not include names, contact details, or other information that identifies someone else
• Attempt to manipulate, exploit, or abuse the AI system
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to harass, threaten, or harm others
• Share explicit, illegal, or harmful content
• Create multiple accounts to circumvent usage limits
• Use automated tools or bots to interact with the Service
• Impersonate others or misrepresent your identity

7. AI-Generated Content

Nature of AI Content

• All responses, feedback, and interactions are generated by artificial intelligence
• AI responses may contain errors, inaccuracies, or inappropriate content
• The system decides response timing, tone, and behavior on its own, including whether a persona stops replying
• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content

Practice, Not Advice

• Texther is designed for conversation practice and skill development
• The Service does not provide professional dating advice, relationship counseling, or therapeutic services
• Feedback is for practice purposes and should not be taken as absolute truth
• We make no guarantees about real-world dating outcomes based on app usage
• If you need professional support, consult a licensed professional

8. Automated Limits and Ratings

Usage caps, skill ratings, and the practice difficulty levels available to you are applied automatically, without human review. If you disagree with a rating or a limit, contact us and we will review it.

9. Intellectual Property

Service Ownership

• Texther, including all code, designs, and content we supply, is owned by us and protected by intellectual property laws
• You receive a limited, non-exclusive, non-transferable license to use the Service for personal purposes

Your Content

• You retain ownership of the messages you write in the Service
• You grant us the right to store, process and display your messages for the sole purpose of operating the Service for you: generating replies, producing your feedback, and showing you your conversations and progress
• We do not use your messages to train AI models, and we do not share them publicly or with third parties for marketing purposes

10. Termination

By You

• You may delete your account at any time from the Profile screen
• Deleting your account does not cancel a paid subscription. Cancel it in your App Store account settings

By Us

• We may suspend or terminate accounts that violate these Terms
• We may modify or discontinue the Service, with reasonable notice where we can give it
• Upon termination, your right to use the Service ends

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, timely, secure, or error-free service
• Accuracy or reliability of AI-generated content
• Any specific outcomes or results from using the Service

If you are a consumer, this section does not exclude any warranty or guarantee that the law of your country of residence gives you and does not allow us to exclude.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for emotional distress, lost profits, data loss, or business interruption
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim

We specifically disclaim liability for:

• Real-world dating outcomes or relationship results
• Emotional reactions to AI-generated content or simulated behavior
• Any actions you take based on feedback or suggestions from the Service
• Service interruptions or data loss

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited by law. Some jurisdictions do not allow these limitations, so they may not apply to you.

13. Privacy

How we collect, use, and protect your data is set out in our Privacy Policy, which is incorporated into these Terms by reference.

14. Push Notifications

• If you turn on notifications, they may contain message content and may show it on your lock screen
• You can turn them off at any time in the app or in your device settings
• Notification delivery is not guaranteed due to device and network limitations

15. Changes to Terms

• We may modify these Terms
• We will notify you of material changes in the app or by email before they take effect
• Continued use after changes take effect constitutes acceptance of the new Terms
• If you disagree with the changes, stop using the Service and delete your account

16. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

Disputes

• We ask that you contact us first at texther@tmmc.me so we can try to resolve the dispute directly
• If you are a consumer, nothing in these Terms takes away your right to bring proceedings in the courts of the country where you live, or to rely on the mandatory consumer protection law of that country. The arbitration and class action waiver below does not apply to you
• If you are not a consumer, any dispute that cannot be resolved directly shall be settled by binding arbitration, and you waive the right to participate in a class action
• Consumers in the EU may also use the European Commission's Online Dispute Resolution platform

17. Apple

• These Terms are between you and TMM Capital only, not with Apple. Apple is not responsible for the Service or its content
• Apple has no obligation to provide maintenance or support for Texther, and no warranty obligation of any kind
• Apple is not responsible for addressing any claim you have relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and claims arising under consumer protection or privacy law
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service

18. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Texther regarding the Service.
